Way 2 USA understands that there is a delicate balance between
Sponsors, Host Companies and the Participants. We screen all
participants to ensure their success once they enter the USA.
For example, if a company has an offer for servers in an upscale
restaurant that requires excellent English skills, you will not
qualify if you only understand basic English.
While this means that you as a Participant will not be able to
accept this position, it also means that Way 2 USA will work with
you to determine your strengths and weaknesses. It does not
help you if you have a job offer for a server in the US and then the
employer refuses to extend the job to you because your English is
not acceptable. This will leave you alone in the USA without a
Employer and quite possibly without accommodations. While it
is still possible to overcome these problems and have a great time
in the USA, the staff at Way 2 USA would rather solve potential
problems before they become a problem.
Additionally, if we send Participants that do not qualify for a
position, it becomes a hassle for both the Host Company and the
Sponsor Company.
For Example, if the above described restaurant is expecting 20
servers and when the Participants arrive they cannot be hired due to
a lack of required English skills, the Host Company will have severe
staff shortages. As a result, they may remove their job offer,
which removes the opportunity for 20 participants that meet the
requirements to have a great position.
It also burdens the Sponsor company, who must then try to help
you find another, suitable position. We solve these problems
by doing things right the first time.
Way 2 USA is dedicated to ensuring the best possible experience
to the Participants, Sponsors and Host Companies. Way 2 USA tries to
check Host Companies to ensure that they are good placements for the
Participants. We also provide continued support throughout the
duration of your program. We will work with Sponsors, Host Companies
and the Participants to help solve issues that may arise.
1. Way 2 USA feels that since the Host Company has made a
commitment to you in the form of a Job Offer, you must:
- Arrive and check in to your Employer and SEVIS in a timely
manner. Often, Employers are on strict timelines to fill
the positions in the job offer. If you delay, your job may
not be available, regardless of your job offer. Employers
are not required to "hold" your job position until you arrive.
Check the arrival dates on your job offer. Be there on
time.
- You should report to your employer and check in to SEVIS no
later than 72 hours after your arrival to the US. The
difference in having the good position that you signed up for
and having no job at all can be a matter of a few hours.
- Since the Host Company extended you a valid position in
their company, you should work at least two weeks in this
position. If you decide to quit your job, you must gain approval by the visa sponsor, before you leave your employer. Please understand that your current employer went out of their way in order to offer you this job. Try to speak with your employer to solve any issues that may arise before terminating your employment. If you would like, the staff at Way 2 USA will try to resolve any employer/employee issues that you may have. Do not show up to your employer and say "I don't want to work
here" or "I have family or friends in another city or state and
I am going there". If you want to be near family or
friends, pick a job offer in the city or at least the state in
which they live. Selecting a job offer that you don't
intend to really accept just to get a visa is unacceptable.
There are too many options that are available for you to "cut
corners". Tell the staff at Way 2 USA before you pick your position. We will work with you to try to ensure that you have the best experience. Our goal is to work together to ensure that all parties involved are satisfied.
- Always give at least 2 weeks notice before leaving or
quitting a job.
- If you are on a H2B visa and Quit or are fired from your
job, you must immediately be transferred to another H2B position
in the USA or return home within ten days. If you quit
your job or are fired, immediately contact the American Way 2
USA office. Depending on the circumstances, Way 2 USA may
find you another position in the USA.
- J1 Work and Travel Participants that do not show up to the
employer in their job offer are subject to visa cancellation.
- H2B Visa holders that do not show up to their employers will
have their visa cancelled by the employer. Way 2 USA
cannot change these terms, as in this case, your employer is
your "Sponsor".
- J1 Trainee's must show up for their employer. You
must work for your employer for the entire duration of your
program.
J1 Work and Travel, H2B Visa Holders and J1 Trainees are required to contact
their sponsor if they:
- Plan to move from one address to another.
- Are terminated or fired from their job.
- Plan to quit your job.
- Are Arrested.
- Are seriously ill.
Failure to comply with the guidelines above WILL RESULT IN VISA CANCELLATION.
The staff at Way 2 USA will work with you through issues that you
may have. We also can contact your family in an emergency.
We ask each and every participant to remember, when you visit the
USA, you are like an ambassador for your country. You will
meet, possibly live with and otherwise interact with Americans on a
daily basis. Please share your culture with them. You
may be the only person from your country that they have ever met.
They will remember you, your actions and stories that you may tell
them about your culture and way of life.
Americans are generally very helpful kind hearted people.
Ask them for assistance if you have minor problems, most of the
time, they will help you.
- Employees are paid correctly. You should receive a
check on a regular basis. Most employers pay either weekly
or every two weeks. A few pay a salary once a month.
Please realize that it may be up to one month from the day you
start work until you receive a payroll check. Be prepared
for this, bring enough money to support yourself. Prices
for food and other things are high in the USA. Estimate
what you will need to support yourself, then double that amount
to be safe. Don't expect for an employer to change their
payroll practices.
- Employees are subject to overtime pay unless noted on the
job offer. Some companies are not required to pay an
overtime rate, such as seasonal amusement parks. The state
of Ohio does not require overtime pay. Check into the
rules under FLSA before you travel. The Fair Labor and
Standards Act applies to all employees and employers. You
can find the Department of Labor website at www.dol.gov
- J1 Visa holders are subject to Federal Withholding taxes and
State Unemployment Taxes (SUTA) depending on the ruling of the
state. J1 Federal Withholding is at a higher rate than
other visa types. Know the rules and withhold taxes
accordingly. FUTA, Medicare and Social Security taxes
should not be withheld from J1 visa holders. H2B visa
holders are subject to the same tax rules as an American
employee.
- If Employers provide accommodations, they should meet all
Federal, State and local guidelines for employee housing.
Participants should each have a bed to sleep on. A detail
of housing that is provided, including estimated costs should be submitted with the job
offer. If housing is not provided by the employer, these
guidelines do not apply.
